The
Firm's Labor & Employment Practice Group represents management in
all aspects of employment counseling and litigation.
With extensive experience representing employers in state and federal
court sexual harassment, discrimination, and wrongful discharge
litigation, members of the Labor & Employment Practice Group have
been particularly successful in convincing plaintiffs and their
attorneys to abandon cases without payment, or to settle matters
for nominal sums. In equal employment matters, the Labor & Employment
Practice Group has defended numerous single plaintiff suits, and
has represented employers in multi-plaintiff cases and in class
actions. Members of the Group have defended employers against claims
of discrimination based on sex, age, race, physical handicap and
national origin, throughout California and in several other states,
including Hawaii, Arizona, Washington, Oregon, Colorado, and New
York. Although many labor and employment lawyers claim to be "litigators"
or have "litigation experience," the Firm's Labor & Employment Practice
Group lawyers have successfully tried several employment cases to
jury verdict. Thus, our Group is comprised of "trial lawyers" who
are well respected by both the Bench and the Bar.
The Labor & Employment Practice Group also represents management
in arbitration and before governmental agencies with jurisdiction
over the employment relationship, including the National Labor Relations
Board, the United States Department of Labor, the California Labor
Commissioner, the Equal Employment Opportunity Commission, the California
Fair Employment and Housing Commission, the Workers' Compensation
Appeals Board and the Unemployment Insurance Appeals Board. Representation
of employers during audits and in litigation brought by the Immigration
and Naturalization Service, and by state and federal agencies enforcing
wage and hour laws and regulations, is regularly undertaken by the
Labor & Employment Practice Group.
In addition to their litigation and administrative law practice,
members of the Labor & Employment Practice Group regularly draft
employee handbooks and counsel with management in the review, development,
and implementation of personnel policies and practices. Attorneys
in the Labor & Employment Practice Group also negotiate collective
bargaining agreements, and advise clients on resisting union organizing
drives, avoiding unfair labor practice charges, and dealing effectively
with strikes, picketing, and boycotts.
Clients served by the Labor & Employment Practice Group include
local, national, and international employers engaged in such diverse
industries as apparel (including numerous surf wear companies) retail,
health care, banking, pharmaceutical, research and development,
computer hardware manufacture and software development, recreation
(including two large ski resorts), entertainment, and construction.
The Labor & Employment Practice Group has assisted clients as diverse
as a ten-person medical group and a publicly held telephone company
with thousands of employees. Widely recognized for their timely
