The Intellectual Property Group actively engages in the procurement, protection, enforcement, exploitation and enforcement of intellectual rights, providing advice and counseling in trademark, copyright, trade dress and unfair competition matters both domestically and abroad. As a result of long, practical experience our attorneys can assist clients in obtaining the appropriate registrations to achieve their business objectives on a cost-effective basis.

Trademarks
Trademarks and service marks are important assets and marketing tools to identify product source and to convey goodwill. We have vast experience in the acquisition of rights to and enforcement of trademarks worldwide, both by registration and through transactions granting rights of usage such as licensing or distribution agreements. We routinely represent a number of corporations involved in trademark licensing, both as licensors and licensees.

Utilizing search services and on-line computer trademark database services, we can provide guidance on trademark use and availability to assist in selection of trademarks and avoid costly infringements.

We routinely prosecute thousands of trademark applications around the world providing a full range of trademark registration services, through an established network of associated attorneys experienced in that aspect of the law. We also register trademarks with the Trademark and Patent Office, as well as with U.S. Customs in appropriate circumstances to prevent counterfeit or parallel imports. We assist in developing an appropriate and cost effective registration program related to the specific needs and objectives of the client.

We help locate and structure strategic alliances such as licensors, licensees, and distributors both domestically and abroad. We have created and managed sophisticated and limited license programs for clients of all sizes. License and distribution agreements are drafted or reviewed to accommodate the specific needs and concerns of the client.

We have assisted in the preparation and administration of anti-counterfeiting programs, including obtaining court orders for seizures, as well as other appropriate injunctive relief, working with police or other government agencies.

Cyber Law and the Internet
We are familiar with the legal aspects of the Internet, including web site development agreements, and intellectual property "clearance" issues relating to uses of intellectual property on the Internet.

Copyrights
We register copyrights in the U.S. and worldwide. We also enforce and protect copyrights, having litigated numerous matters involving copyrights and their violation in many jurisdictions. We advise with regard to the selection of appropriate insurance and the securing of appropriate insurance protection wherever possible.

Litigation
While recognizing that litigation can be expensive and time consuming, and should be regarded as a remedy of last resort, there are times and situations where there is no other way to enforce or protect a client. Our litigation department has had extensive experience with all types of intellectual property litigation in many jurisdictions. We have been involved in the prosecution and defense of many trademark, copyright, trade dress and unfair competition matters, in federal and state courts and outside the U.S. in conjunction with associate counsel in various countries experienced in these matters.

Anti-Counterfeiting
This section is available to assist clients with the following services:

  • Creation of a worldwide or regional anti-counterfeiting/anti-piracy program,
    including overseeing regional investigations and foreign counsel.
  • Creation of anti-piracy/anti-counterfeiting materials for U.S. Customs
    and government enforcement officials.
  • Service of Cease and Desist Notices.
  • Conduct and organize civil and/or criminal seizures of counterfeit products.
